In the name of God Amen I THOMAS FRANKLIN SENR. of the County of Jefferson and State of Alabama do make and declare this my last will and testament in manner and form following First I Resign my soul into the hands of Almighty God who gave it, hoping and believing in a remission of my sins, by the merits and mediation of Jesus Christ. And my body I commit to the earth to be buried at the discretion of my executors herein after named And my wordly estate I give and devise as follows: First I Give and bequeath unto MARY FRANKLIN my beloved wife All myEstate both real and personal to have and to hold all the said estate both real and personal with all the profits and benefits arising out of said estate during her remaing my widow, and at the expiration ofher widowhood or death, I give and devise all the above named estate to my ten Children the heirs of my body JAMES FRANKLIN, UNIS CLARK, BETSEY CLARK, MARGARET CHAPELL, SARAH CHAPELL, THOMAS FRANKLIN JR., NANCY MORE, MARTHA RAMSEY, JENNY MOORE, SILAS FRANKLIN (with there servation of one Child's part of the whole estate). Among them to be equally divided including the above reservation, which reservation or equal parts I Give and devise unto WILLIAM MCGREGER and for them the said heirs of my body and WILLIAM MCGREGER to have and possess the above named estate immediately after the death or end of widowhood of my wife MARY which said estate I do devise and give to them theirheirs and assigns. Also I will and ordain that the executor or executors of this my last will and testament, for and towards the performance of my said testament shall with all convenient speed after the decease of my wife MARY divide to ALEEN? in fee simple all the above recited Amongst the above heirs of my Body and WILLIAM MCGREGER whereof I do by these presents give to my said executor or executors full power and authority to divide and dispose of the above named estate in the way and manner herein named. And I do hereby appoint my trusty friends THOMAS FRANKLIN JUN. And SAMUEL CLARK Executors of this my last will testament and do give them what may be considered compensation to be paid them out of my estate before division thereof in consideration of the pains and trouble they will have in execution of this my will. In the name of God Amen I John Wilky of the State of Georgia and County of Wilkes planter being very sick and weak in ? or in perfect health of body but ? and perfect mind and memory thanks be given unto God calling unto mind the mortallity of my body, and knowing that it is appointed for all men to die do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my soul into the hands of of (sic) Almighty God that gave it and my Body I recommend to the Earth to be buried in a decent Christian Burial at the discretion of my Executors nothing (blank space) but at the General Resurrection I shall receive the same again by the Almighty power of God and as touching such worldly Estate wherewith it pleased God to Bless me in this life I give ?? and dispose in the following manner and form
I give and bequeath to Elliner my Dearly Beloved wife to have my whole Estate after the discharge of my lawful Debts and I do utterly disallow and revoke and disannul all and every other former Testaments Wills Legacies and Bequeaths Ratifying and Confirming this and no other to be my last Will and testament. In Witness whereof I have hereunto set my hand and seal this 4th March 1799.
Signed Sealed published pronounced and declared by the said John Wilkey as his last Will and Testament in the ? and in the ? of Each Other have hereto Subscribed our name.
